Customs IP protection

Some LATAM countries have created a mechanism aimed at stopping the traffic of counterfeited trademarks. This information is stored in a computerized system to fight trademark infringement.

This mechanism consists on an “Alert System” intended to preclude trademark forgery. Therefore, the recordal of trademarks into this system may become very beneficial whenever a trademark is the object of a forgery or fraudulent imitation.

In those countries wherein no “customs IP protection” regulations are available, other actions can be taken before each local authority. The best strategy may vary from one country to other, depending on different factors, such as customs location, civil and/or criminal actions available, among other.
