City wins fight to protect historic celebration
Through Resolution N°8525, the Colombian PTO (SIC) ruled that the trademark application for “FIESTA DE LA COSECHA” filed by Julián Dávila Marin would not be granted.
The Municipal Institute of Culture of the city of Pereira lodged an opposition against the trademark application filed by Marin. The main argument was the fact that the term “FIESTA DE LA COSECHA” is related to the local and traditional celebration that started a 100 years ago. During this annual party, residents celebrate the local coffee tradition of the region called Risaralda. Consequently, the “FIESTA DE LA COSECHA” is a term that belongs to the local cultural heritage.
Since the local PTO decided that the city’s arguments were valid, and also took into consideration Andean Decision 486, which establishes the common IP regime for Andean Community members, the trademark application was denied.
