Priority examination of resident patent applications
On January 19, by means of Resolution No. 153/2015, the Brazilian Institute of Industrial Property (INPI) launched the pilot project “Priority BR,” aimed at examining resident patent applications within nine months.Resident patent applications are those in which the first-named applicant or assignee is a resident of Brazil.
According to the new project, Brazilian companies and inventors who have made an initial application for a patent in Brazil, and also applied abroad, may request priority examination for their application.
The pilot project “Priority BR” will last for one year and the number of participating patent applications is limited to a maximum of 100.
The goal of the project is to encourage the introduction of innovative Brazilian products protected by industrial property rights into the global market.
According to 2014 data, 7,395 resident patent applications were filed in Brazil, and only 506 entered the Patent Cooperation Treaty (PCT) system.
