New Law about Musical Works
The Federal Law 12.192, dated January 14th 2010, establishes that it is mandatory to make a legal deposit at the National Library of every musical work in the Portuguese language and divulged in the Brazilian market.
According to the above mentioned law, editors, phonogram producers and video producers are obliged to deposit two copies of each piece of music edited or published by them within 30 days from publication of the work and inform the National Library about all performances of the musical work published and released in the market.
The failure of the deposit of musical works in terms defined by this Act will result in the imposition of a fine corresponding to 100 (one hundred) times the value of the work in the market and seizure of copies in sufficient numbers to meet the purposes of deposit.
Finally, it is important to advice that the mandatory deposit cannot get mixed up with the registration provided in the Copyright Law for the purpose of identifying prior creation and record copyright assignments.
