New patent examination guidelines currently subject to public consultation
On March 16, 2015, the Brazilian PTO (INPI) announced the launch of a public consultation on the draft of Part II of the Patent Examination Guidelines. Interested parties can send their comments or proposals to the guidelines until May 14, 2015, by filling in this form.
Part II of the Guidelines address the following topics: non-patentable subject matter, industrial application, prior art, novelty, inventive step, as well as specific chapters on Markush claims and compositions. The draft version of these guidelines is available for download here (only a Portuguese version available).
Previously, from July to September 2012, Part I of the guidelines dealing with the title, specifications, claims, drawings and abstract was also subjected to public consultation. This part came into force on April 12, 2013.
Additionally, INPI launched public consultations during 2012-2013 on the following examination guidelines: patents implemented by computer programs, utility models, and patents in the biotechnology area.
